Brownfield Regulation

In the fall of 2008, the Ontario Ministry of the Environment (MOE) released proposed regulatory amendments to O.Reg. 153/04, (also known as the Brownfield Regulation). 

Brownfield sites are former industrial or commercial properties, contaminated or derelict from their former use, which have redevelopment potential.

The current Brownfield Regulation (promulgated in 2004) represents an initial attempt by the Ontario Government to reach their environmental and economic objectives to build sustainable communities.  The proposed MOE reforms to the Brownfield Regulation are the government’s attempt to tackle some of the current constraints in the legislation preventing full and timely use of these opportunities.

The proposed reforms include:

  • Enhance Record of Site Condition (RSC) Integrity
  • Off-Site liability protection
  • Strengthened soil, sediment and groundwater standards
  • A Streamlined Risk Assessment process

Pinchin will discuss the proposed reforms and how they will affect site assessment, remediation, redevelopment and financing.


Risk Assessment (RA)
